Official Rules
NO PURCHASE NECESSARY. A PURCHASE DOES NOT IMPROVE YOUR CHANCE OF WINNING.
1. Eligibility: The Chilling Tales Sweepstakes (“Sweepstakes”) is open only to legal
residents of the 50 United States, the District of Columbia and Canada (excluding
Quebec), who are 18 years of age or older as of June 25, 2009. Void in Puerto
Rico, Guam, all other U.S. territories and possessions. Employees of Roto-Rooter
Services Company, Roto-Rooter Corporation, Chemed Corporation and / or their
respective subsidiaries, affiliates, distributors, suppliers, advertising and
promotion agencies, franchises, and contractors (collectively, “Sponsor”) and
each employee’s immediate family / household members (including employee’s
husband or wife and mother, father, sister, brother, child, and their respective
spouses as well as those living in their same households), are not eligible to
participate or win a prize. Sweepstakes void where prohibited by law. All
applicable federal, state and local laws apply.
2. One way to Enter: Go to www.rotorooter.com or www.chillytales.com between
12:01 a.m. Eastern Time on June 25, 2009 and 11:59:59 p.m. Eastern Time on
September 15, 2009 to complete and submit the Official Online Entry Form. The
registration form requires your title, full name, address, city, state or province
including zip code, birth date, telephone number (with area code) and email
address. Complete the on-line registration form and click the “Submit” button to
enter. Submission of erroneous or incomplete information will void the submitted
entry. Sponsor is not responsible for lost, late, misdirected entries or entries not
received. Proof of delivery or transmission will not be regarded by Sponsor as
proof of entry. All entries become the property of the Sponsor and will not be
acknowledged or returned. Limit one (1) entry per household or per e-mail
address per day. If multiple entries are received from any household or e-mail
address on a given day, only the first such entry per day will be eligible. Should
multiple users of the same email account enter the Sweepstakes and a dispute
thereafter arise regarding the identity of the entrant, the authorized account
subscriber of said email account at the time of entry will be considered the
entrant. “Authorized account subscriber” is defined as the natural person who is
assigned an email address by an Internet access provider, on-line service provider
or other organization, which is responsible for assigning email addresses for the
domain associated with the submitted email address. The use of electronic
automated devices or any other devices intended to automate any aspect of
Sweepstakes entry is strictly prohibited. Any attempted form of entry other than
as described herein is void.
3. Prizes: First Prize (1) a trip for two to attend a 3-day ghost hunting event with
TV’s Ghost Hunters, Jason Hawes and Grant Wilson, at the Stanley Hotel in
Estes Park, Colorado from November 6-9, 2009. First prize includes air fare
between Denver, Colorado and the nearest major airport to winner’s residence as
determined by Sponsor and a three-night stay at The Stanley Hotel in Estes Park,
Colorado on November 6, 7, and 8, 2009, single room/double occupancy.
Checkout and departure will be on November 9, 2009 in accordance with hotel
policy. First prize also includes a Saturday night dinner at the event where winner
and travel companion will be special dinner guests seated at the dining table of
either Jason Hawes or Grant Wilson to be determined by Sponsor. First prize also
includes up to a $500 stipend to cover ground transportation to and from the
airports and meals during winner’s stay, which are not already included in the
event package. The Chilling Tales Sweepstakes first winner is solely responsible
for arranging his or her own ground transportation for winner and travel
companion from home to airport, from airport to hotel, from hotel back to airport,
and from airport back to home, and any other incidental travel. All other costs or
expenses associated with or incurred during use of first prize (including alcohol, if
any) are specifically excluded from prize. Travel companions must be at least 18
years old and, before travel, must sign a waiver and release of liability as
described below. Actual value of this prize package depends on costs associated
with airfare from winner’s city of residence to Denver.
Second prize (1) a weekend trip for two to TV’s Ghost Hunters’ (Jason Hawes and Grant Wilson) Spalding Inn in Whitefield, New Hampshire from October 16- 18, 2009. Second prize includes air fare between either Burlington, Vermont International Airport or Manchester-Boston Regional Airport and the nearest major airport to second prize winner’s residence as determined by Sponsor and a two-night stay at Spalding Inn in Whitefield, New Hampshire on October 16 and 17, 2009, single room/double occupancy. Checkout and departure will be on October 18, 2009 in accordance with hotel policy. Second prize also includes up to a $500 stipend to cover ground transportation and meals throughout second prize winner’s stay which are not already included in the event package. The Chilling Tales Sweepstakes second prize winner is solely responsible for arranging his or her own ground transportation for second prize winner and travel companion from home to airport, from airport to hotel, from hotel back to airport, and from airport back to home, and any other incidental travel. All other costs or expenses associated with or incurred during use of second prize (including alcohol, if any) are specifically excluded from prize. Travel companions must be at least 18 years old and, before travel, must sign a waiver and release of liability as described below. Actual value of this prize package depends on costs associated with airfare from second prize winner’s city of residence to either Burlington, Vermont International Airport or Manchester-Boston Regional Airport.
Sponsor makes no warranties with regard to the prizes. Sponsor at its sole
discretion shall make all decisions regarding travel arrangements that are
specified herein as being awarded. Prizes are not transferable. No substitutions of
prize allowed by winner(s), but Sponsor reserves the right to substitute a prize of
equal or greater value due to prize unavailability. Prizes are not redeemable by
winner for cash value. Winners are solely responsible for all costs and expenses
associated with the acceptance of prizes not specified herein as being awarded,
including, but not limited to, all federal, state, local and provincial taxes. Prize
notifications and prizes will be sent to addresses in the 50 United States and
Canada (excluding Quebec) only. Any depictions of prizes are for illustrative
purposes only. Prizes will be awarded no later than October 11, 2009. Odds of
winning will depend on the number of entries.
4. Drawing: Winners will be selected from a random drawing to be conducted on or about September 16, 2009, from among all eligible entries received by Sponsor.
Decisions of Sponsor are final and binding in all matters relating to the
Sweepstakes. Potential winner(s) will be notified by phone, mail or e-mail within
five (5) days of drawing. Each entrant selected as a potential winner must comply
with all terms and conditions set forth in these Official Rules, and winning is
contingent upon fulfilling all such requirements. All prizes will be awarded. If a
potential winner cannot be reached after a reasonable effort has been exerted as
determined by Sponsor, if he/she is found to be ineligible, if he/she cannot or does
not comply with these Official Rules, or if his/her prize or prize notification is
returned as undeliverable, that potential winner will be disqualified and a second
drawing will take place on or about September 29, 2009 whereby an alternate
potential winner will be selected from the remaining eligible Entries, at Sponsor’s
sole discretion.
5. Terms and Conditions: Sweepstakes is subject to these Official Rules and all
federal, state, provincial, and local laws (collectively “Rules and Laws”). If a
Canadian resident is selected as a winner he/she must correctly answer a timebased
mathematical skill test administered by phone/mail to be eligible for a
prize. Potential winners and their travel companions will be required to execute,
sign, have notarized and return an Affidavit of Eligibility, a Liability Release, a
Publicity Release (where legal) and any other documentation that Sponsor
requires (collectively “Affidavit/Release”), which may require social security
number, within seven (7) days after notification. All winners must produce picture
or some other form of proper identification to claim any prize. Any failure to
accurately, fully and timely comply with the Affidavit/Release or these Official
Rules, any mail or email to the potential winner returned as undeliverable, or any
phone number provided by potential winner that is incorrect or no longer in
service may result in disqualification of a potential winner at Sponsor’s sole
discretion. Sponsor is not responsible for late, lost, damaged, incomplete,
illegible, faulty, or incorrect transmissions, incorrect announcements of any kind,
technical hardware or software failures of any kind, any damage to any person's
computer related to or resulting from participating in the promotion, lost or
unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user’s ability to participate in the
Sweepstakes whether caused by computer, technical or human error. Sponsor is
not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of prizes. By returning
the completed Affidavit/Release, winner attests to the authenticity of his/her
winning entry. Except where prohibited by law (1) entry and/or a winner’s
acceptance of prize constitutes permission for the Sweepstakes Sponsor to use a
winner’s name, address (city, state or province), photo, likeness, biographical
information, statement and voice for advertising/publicity purposes worldwide
and in all forms of media, in perpetuity, without further notice to or compensation
in connection with said Sweepstakes or the prizes awarded and (2) Sponsor has
the right to modify, edit, adapt, electronically alter, use, assign and/or dispose of
such Entries however it sees fit and for any purpose without any notice or
compensation to an entrant or any third parties. Any person attempting to defraud
or tamper with this Sweepstakes will be prosecuted and is not eligible for a prize.
If, for any reason, the Sweepstakes is not capable of running as originally
planned, is potentially compromised by virus, bugs, non-authorized human
intervention or conduct, or other causes beyond the control of Sponsor, which
corrupts, impairs or potentially compromises the administration, security, fairness
or proper play of the Sweepstakes or any portion thereof, Sponsor at its sole
discretion, reserves the right to terminate, cancel, suspend or modify the
Sweepstakes in whole or in part. Sweepstakes is governed by the laws of the State
of Ohio with venue in Hamilton County, Ohio and all claims must be resolved in
the courts of Hamilton County, Ohio. Winner assumes all liability for any injury
or damage caused, or claimed to be caused, by participation in this promotion or use or redemption of any prize. By participating in this program, entrants agree to
be bound by the Official Rules and the decisions of Sponsor. Winner releases and
agrees to hold harmless Sponsor including Roto-Rooter Services Company, Roto-Rooter Corporation, Chemed Corporation, their employees, parents, divisions,
subsidiaries, franchises, contractors, affiliates, advertising, promotion and public
relations agencies and representatives from any and all liability for any injuries,
loss or damage of any kind, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize or participation in this Contest.
The invalidity or unenforceability of any provision of these Official Rules shall
not affect the validity or enforceability of any other provision. In the event that
any provision is determined to be invalid or otherwise unenforceable or illegal,
these Official Rules shall otherwise remain in effect and shall be construed in
accordance with their terms as if the invalid or illegal provision was not contained
herein.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE INCLUDING www.rotorooter.com AND/OR
www.chillytales.com OR UNDERMINE THE LEGITIMATE OPERATION OF
THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL
LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR(S)
RESERVE(S) THE RIGHT TO DISQUALIFY AND/OR SEEK DAMAGES
FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY
LAW
7. Use of Data. Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy. Please review the Sponsor’s privacy policy at www.rotorooter.com. By participating in the Sweepstakes, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.
8. List of Winners: Following the conclusion of the contest, information concerning the winner will be available upon request after October 11, 2009.
